1. OPERATOR & SCOPE
The Gazoo Racing Shop Europe Webshop (the "Webshop") is operated by:

The Webshop is a business-to-business (B2B) platform, exclusively reserved for professional users acting in the course of their commercial, industrial, or professional activities, including members of the authorized Toyota network.
By accessing and using the Webshop, you confirm that you are acting as a professional and agree to be bound by these Terms & Conditions and all applicable laws.

2. WEBSITE & PRODUCT INFORMATION
2.1 Website Navigation
Products are organised into categories accessible via the main navigation menu. Product pages include images and descriptions intended to assist professional purchasing decisions. Product images are non-contractual.
2.2 Product Information
All commercial, technical, and descriptive information is provided for information purposes only.
TME and its partners reserve the right to modify product information, specifications, availability, or assortments at any time and without prior notice.
Products offered via the Webshop are intended for distribution within Europe. Each market remains responsible for compliance with applicable local laws, regulations, customs, and import requirements.
3. PRICES
The Gazoo Racing Shop operates as a B2B platform.
- All prices are displayed in Euros (EUR)
- Prices exclude VAT, shipping costs, and any applicable duties, unless otherwise stated
Any indicated Recommended Selling Prices (RSPs) are provided for reference only and are non-binding. Actual resale prices remain at the discretion of the purchasing entity.
All purchases are governed by the terms of the applicable commercial sales contract between the parties.
4. AVAILABILITY & DELIVERY
4.1 Product Availability
Orders are processed on business days only. If a product is unavailable, the customer will be informed within 48 hours of order placement.
4.2 Delivery Times
Indicative delivery times are as follows:
- Express delivery: 1–3 working days
- Economy delivery: 2–5 working days
Delivery times are estimates only and are non-binding. Delays shall not give rise to any right to compensation, cancellation, or damages.
5. ORDERS
5.1 Placing an Order
Orders are placed by adding products to the shopping cart and completing the checkout process. Quantities may be modified prior to order confirmation.
5.2 Order Acceptance
An order confirmation email acknowledges receipt of the order but does not constitute acceptance.
The contract is deemed concluded only upon shipment confirmation or explicit written acceptance by d-side SA or TME.
6. PAYMENT
Accepted payment methods include:

For payments by bank transfer, payment must be received within 3 working days of order placement.
Failure to receive payment within this period may result in automatic cancellation of the order without further notice.
7. ORDER CANCELLATION
Orders cancelled by the customer after confirmation are not eligible for refund or compensation, unless otherwise agreed in writing.
In the event of cancellation by d-side SA or TME, any payments already received will be refunded. No further compensation shall be due.
8. RECEIPT, NON-CONFORMITY & DAMAGED PRODUCTS
Customers must inspect goods immediately upon delivery.
Any claims relating to damage, non-conformity, missing items, or delivery errors must be:
- Submitted within 5 working days of delivery
- Sent by email with detailed description and supporting photographs
- Noted clearly on the delivery slip (general reservations are not accepted)
Original packaging must be retained. Customers must cooperate fully with any verification process.
Accepted claims may result, at TME's discretion, in replacement or refund.
9. RETURNS
Returns are accepted only with prior written approval from d-side SA.
Return conditions:
- Request submitted within 5 working days of receipt
- Products unused, complete, and in original packaging
- Return shipment arranged and paid by the customer, unless otherwise agreed
No returns will be accepted for:
- Clothing
- Customised or personalised products
- Limited editions or special-event items
- Products showing signs of use or damage

Risk of loss or damage during return transport remains with the customer.
10. DATA PROTECTION
Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and applicable data protection laws.

11. INTELLECTUAL PROPERTY
All content on the Webshop, including text, images, trademarks, logos, and designs, is protected by intellectual property rights.
Any reproduction, distribution, or commercial use without prior written consent from TME is prohibited.
12. LIABILITY
To the maximum extent permitted by law, TME and d-side SA disclaim all liability for indirect, incidental, or consequential damages arising from the use of the Webshop or the purchase of products.
Professional users expressly waive any consumer protection rights that do not apply to B2B transactions.
13. APPLICABLE LAW & JURISDICTION
These Terms & Conditions are governed exclusively by Belgian law.
Any dispute arising from or relating to these Terms & Conditions shall fall under the exclusive jurisdiction of the courts of Brussels, Belgium.
14. UPDATES
TME reserves the right to amend these Terms & Conditions at any time. The version in force at the time of order placement shall apply.

3. Prices
All prices are displayed in Euros (EUR) and include applicable VAT, unless otherwise stated. Shipping costs are shown separately before order confirmation.
The total price payable is confirmed during checkout. Once confirmed, a binding purchase contract is formed in accordance with these Terms & Conditions.
4. Availability & Delivery
4.1 Product Availability
Orders are processed on business days only. If an item is out of stock, you will be informed within 48 hours of placing your order.
4.2 Delivery Times
Deliveries are handled by professional courier services.
- Express delivery: 1–3 working days
- Economy delivery: 2–5 working days
Delivery times are indicative and may vary due to destination, customs procedures, or force majeure events. Delays do not automatically entitle the customer to compensation.
5. Orders
5.1 Placing an Order
Products may be added to your shopping cart and modified before checkout. Availability and delivery options are displayed prior to order confirmation.
5.2 Order Confirmation
An order confirmation email is sent once the order is placed. Dispatch confirmation and tracking details are provided once the order has shipped.

7. Right of Withdrawal & Return Procedure (B2C)
In accordance with applicable legislation, the customer has a period of fourteen (14) calendar days from receipt of the product to exercise their right of withdrawal, without having to provide any reason and without incurring any costs other than those provided for by law.
To exercise this right, the customer must notify their decision to withdraw by means of an unambiguous statement (for example, by email to TGR.Merch@d-sidegroup.com).
To facilitate the processing of returns, the customer is invited to contact our customer service in advance at TGR.Merch@d-sidegroup.com in order to receive return instructions. However, this prior contact is not a condition for exercising the right of withdrawal.
The customer then has a period of fourteen (14) days from the communication of their decision to withdraw to return the product to the address that will be provided to them.
Products must be returned in their original condition, complete (packaging, accessories, instructions, etc.), and in a state allowing them to be resold as new. The customer may be held liable for any depreciation in value resulting from handling other than what is necessary to establish the nature, characteristics, and proper functioning of the product.
The direct costs of returning the goods shall be borne by the customer, unless stated otherwise.
A refund of all payments received, including standard delivery costs, will be made within fourteen (14) days from the notification of withdrawal. However, we reserve the right to withhold the refund until we have received the goods back or until the customer has provided proof of shipment of the goods, whichever occurs first.
Withdrawal Exceptions
The right of withdrawal does not apply to:
- Customised or personalised products
- Limited editions or special-event items
- Products showing signs of use or damage
8. Faulty or Damaged Products
Customers must inspect goods upon delivery. In case of damage, non-conformity, or missing items:
- Notify us by email within 5 working days of delivery
- Provide clear photos and a detailed description
- Retain original packaging
Accepted claims may result in a replacement or refund where applicable. Return shipping costs will be reimbursed upon presentation of proof.
9. Returns (Non-Defective Goods)
Returns must:
- Be requested by email within the withdrawal period
- Include unused products in original packaging
- Be approved prior to shipment
Returns without prior approval will not be accepted.
